update on the curfew

As reported in the Journal de Montréal......Transport Minister Norm McMillan will be tabling that Bill today,Oct 27 2010,at the National assembly but this curfew will be altered.

The curfew will now be between midnight and 6 a.m.It will not be applied this coming season but for 2011-2012 season

Would this be for all trails or just ones in residential areas?

Provincialwide except for very remoted areas such as lower north shore for instance where snowmobiling is a way of transportation.

As for populated areas and/or residential areas.There will be some sort of a mechanism where municipalities will get the possibility to apply the law or not accordingly.

Yes it is true that efforts to amend the propsed curfew have been successful. Rather than presenting the bill as originally written and then going through the amendement process where obviously there would be much objection as well as the known presentation of petitions representing near 8,000. The Minister dedcided to alter the bill at the time of its presentation. The new timetable, times of restriction and the exceptions seem to be a much more reasonable action. The offset which is of great importance to the permanance and protection of the trail system is the extention of the immunity from lawsuits against snowmobile clubs. Invited for attendance at yesterday's important announcement were the Presidents of the AdmdQ, the FCMQ and VTT organizations. Our orgsanized voice was most definetly represented, heard, consulted and recognized. Nice job on behalf of all Quebec snowmobilers.

Snowmobilers were stunned last September when the Minister for Transport, Norman MacMillan, told them that he was preparing to ban traffic on the trails between 10 pm and 6 am on weekdays and between 11 pm and 6 am during the weekend.

Finally, sources have confirmed that they have managed to convince the minister to be more conciliatory.

Thus, the bill that was presented Wednesday MacMillan in the National Assembly stipulated that the new legislation will not apply this season.

Moreover, the curfew imposed on snowmobiles from the winter 2011 will be from midnight to 6 am, enabling them to move into the late evening, Monday to Sunday.

The legislation also provides a mechanism allowing the possibility for regional county municipalities to evade the curfew.

Exceptions

In addition, traffic at night will not be prohibited in areas where snowmobiling is seen as a means of transport and not as a leisure activity, on the Lower North Shore, for example.

Consumers can also ignore the curfew in areas that are not inhabited, as the Parc des Laurentides linking Quebec City and Saguenay-Lac-Saint-Jean.

In return for these restrictions on snowmobile enthusiasts, which will impact hours of operation, the government will extend to 2017 the immunity from lawsuits granted to snowmobile clubs responsible for trail maintenance.

This immunity prevents citizens who live along the trails, and who claim to suffer from traffic noise caused by snowmobiles, to take legal action against the club officials. It was decreed in 2004 by former Minister Julie Boulet for a temporary period of 16 months to protect a section of 20 000 miles of trails in the famous case of the Petit Train du Nord in the Laurentians. The immunity was then extended to May of 2011.

The bill as adjusted and introduced is now in the process of comment and discussion. Yesterday was a very important day as the AdmdQ were invited to the assembly for comment. Here is a link to the testamony. Most of us won't understand what is being said, but the hugely important note is that the professionally presented voice of snowmobilers is an invited and recognized presence in the process. This has never been the case before and is a very important step in protecting the future of our sport. There are many componets to this proposed new law and our voice is being heard and consulted on all. No after the fact bitchin at the bar about something that has happend without our input, a real productive proactively involved voice. Check out a little bit and see how well represented we can be.

BRP was also invited for comment as obviously they are a big player in quebec and this industry (link below). It is interesting to see this process and realize how important having a role and representation in it, is and will continue to become. I invite our french speaking QR's to encourage more quebecers to support the organised, recognised voice of the AdmdQ. Greater membership equals greater credibility and more resources for programs and initiatives important to snowmobiling, plus the available discounts are a good deal. Quebecer members even get 6 issues of Sports motorises mailed to them for free. Unfortunatly the postage is way too much for this to be offered to us out of country members. I continue to be very proud that a significant number of QR's have added their voice and support. There were many other components of this legislation in addition to the original curfew piece that was of such focus.
